Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Nya Foundation ("we", "us") and govern your access to and use of Latent (the "Service"). By accessing or using the Service, you agree to these Terms, our Content Policy, and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in Texas, USA, to create a designer account or upload content. The Service is not directed to, and may not be used by, children. By using the Service you represent that you meet this requirement.

2. Accounts & access

Designer accounts are created through third-party single sign-on (such as GitHub or Google); we never set or store a password for you. You are responsible for maintaining control of the identity provider you sign in with and for all activity that occurs under your account. Notify us promptly at k3scat@gmail.com of any unauthorized use. You may stop using the Service at any time and request deletion of your account.

3. Your content & license

You retain ownership of the content you upload. You grant Latent a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt (for example to generate thumbnails and web-optimized derivatives), and publicly display your uploaded content for the purpose of operating and showcasing the gallery. Public uploads are visible to anyone. This license ends when you delete the content or your account, except for copies retained in backups for a limited time or as required by law. You represent that you have the rights to upload your content and that it does not violate our Content Policy or any applicable law.

4. Acceptable use

You must comply with the Content Policy. Do not use the Service as a generic file host or image CDN, do not hotlink media from other sites, and do not abuse, overload, scrape, or attempt to disrupt the Service.

5. Moderation & removal

We may remove content and suspend or terminate accounts that violate these Terms or the Content Policy, at our discretion and without liability. We also honor valid DMCA takedown requests.

6. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. Content is user-submitted and AI-generated; generation metadata and tags may be inaccurate. We do not endorse user content.

7. Limitation of liability

To the maximum extent permitted by law, Nya Foundation and the project's contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or relating to your use of the Service.

8. Indemnification

You agree to indemnify and hold harmless Nya Foundation and the project's contributors from any claims, damages, liabilities, and expenses arising out of content you upload or your violation of these Terms, the Content Policy, or any law.

9. Open source

The Service's source code is open source and provided without warranty. Running your own instance is your responsibility, including legal compliance in your jurisdiction.

10. Changes & governing law

We may update these Terms from time to time; material changes will be reflected by the effective date above, and your continued use of the Service constitutes acceptance. These Terms are governed by the laws of Texas, USA, without regard to its conflict-of-laws rules.
